1. Acceptance of Terms

By installing or using FailBrief ("the Service"), you agree to be bound by these Terms and Conditions. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

FailBrief is provided as a software service accessible globally through cloud infrastructure. You must be at least 18 years old to use the Service.

2. Description of Service

FailBrief is a GitHub App that provides AI-powered analysis of CI/CD workflow failures. The Service automatically analyzes failed workflows and posts structured summaries as comments on pull requests.

Required Permissions: By installing FailBrief, you grant the app permission to:

  • Read repository metadata and workflow run logs
  • Post comments on pull requests
  • Receive webhook notifications for workflow runs

You may revoke these permissions at any time by uninstalling the GitHub App.

3. Plans and Billing

Payment processing is handled by Stripe, Inc., a third-party payment processor. Your payment information is processed securely and is not stored on our servers. By subscribing, you agree to Stripe's Terms of Service.

  • Free Plan: Includes 10 monthly analyses with low priority queue processing at no cost.
  • Paid Plans: Starter ($9/month), Pro ($29/month), and Business ($59/month) plans offer increased analysis limits and priority processing.
  • Paid plans are billed monthly in USD. You may cancel at any time, and your subscription will remain active until the end of the current billing period.
  • We reserve the right to modify pricing with 30 days' notice. Existing subscribers will be grandfathered into their current pricing for the remainder of their billing cycle. Price increases will take effect on your next renewal date.

4. Refunds and Cancellations

  • Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Your access will continue until the end of your current billing period. No refunds are provided for partial months.
  • Refunds: We offer refunds within 14 days of your initial subscription purchase if you are unsatisfied with the Service. Refunds are not available for subscription renewals or after 14 days from the initial purchase.
  • Chargebacks: Initiating a chargeback instead of requesting a refund may result in immediate termination of your account and access to the Service.

5. Usage Limits

Each plan includes a specific number of monthly analyses. When you reach your limit, no additional analyses will be performed until the next billing cycle. Unused analyses do not roll over to the next month.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or hack the Service
  • Abuse the Service through excessive API calls, deliberate workflow failures, or attempts to bypass usage limits
  • Share your account credentials or allow unauthorized access to your subscription
  • Resell or redistribute access to the Service without permission
  • Use the Service to process malicious code, malware, or content that violates third-party rights

7. Intellectual Property

The Service, including its design, features, and documentation, is owned by FailBrief and is protected by intellectual property laws. Your code, repositories, and workflow logs remain your property. We claim no ownership over your content.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We are not liable for:

  • Scheduled maintenance (we will provide reasonable notice when possible)
  • Service interruptions due to third-party failures (GitHub, OpenAI, AWS, or other providers)
  • Force majeure events beyond our reasonable control
  • Network or connectivity issues outside of our direct control

We do not provide service-level agreements (SLAs) or uptime guarantees for any plan tier.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

We specifically disclaim all warranties including:

  • Merchantability, fitness for a particular purpose, and non-infringement
  • That the Service will be error-free, secure, or uninterrupted
  • That AI-generated analyses will be accurate, complete, or suitable for your needs
  • That defects will be corrected or that the Service is free from viruses or harmful components

AI-generated failure analyses are for informational purposes only and may not always be accurate. You should verify all suggested fixes before applying them to production code. Use the Service at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law:

  • FailBrief shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability to you for any claims related to the Service shall not exceed the amount you paid to FailBrief in the 12 months preceding the claim, or $100 USD, whichever is greater.
  • We are not responsible for damages resulting from:
    • Incorrect or incomplete AI-generated analysis
    • Application of suggested fixes to production code or systems
    • Service downtime, interruptions, or unavailability
    • Data loss, corruption, or unauthorized access
    • Third-party service failures (GitHub, OpenAI, AWS, Stripe)
    • Security breaches beyond our reasonable control
    • Any business losses, including loss of revenue, profits, or anticipated savings

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless FailBrief from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Content you provide to the Service (including your code, repositories, and workflow logs)
  • Any negligent or wrongful conduct by you or anyone accessing the Service through your account

12. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

13. Termination

You may terminate your use of the Service at any time by uninstalling the GitHub App and canceling your subscription. We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with internationally recognized principles of commercial law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

Any dispute arising from or relating to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in English, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

If for any reason arbitration is unavailable or unenforceable, you agree to submit to the jurisdiction of courts competent to hear the matter, and you waive any objection to venue or personal jurisdiction.

15. Assignment

You may not assign or transfer these Terms, your account, or any rights granted hereunder without our prior written consent. We may assign these Terms to any successor or acquirer of FailBrief without restriction or notice to you.

16. Severability and Waiver

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions. Any waiver must be in writing and signed by an authorized representative of FailBrief.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FailBrief regarding the Service and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.
